Privacy Policy of the Municipal Photographic Portal fotoportal.poznan.pl

I. General Information

  1. In the interest of preserving the right to privacy of the users of the Municipal Photographic Portal (hereinafter referred to as the “FotoPortal”) and fulfilling the requirements resulting from legal provisions, the City of Poznań informs about the manner in which data provided by FotoPortal users (hereinafter referred to as “Users”) is collected, processed, and secured.
  2. Before registering, the User should familiarize themselves with the content of this Privacy Policy.

II. Personal Data Administrator

  1. The Personal Data Administrator (hereinafter referred to as the “Administrator”) of the personal data provided by the User while using the FotoPortal is the Mayor of the City (Prezydent Miasta) with headquarters at plac Kolegiacki 17, 61-841 Poznań.
  2. The Administrator processes personal data in accordance with applicable law, including the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”) and the Act of 18 July 2002 on the provision of services by electronic means. The recipient of the data is the entity responsible for the Administrator's IT services (creation, development, and IT maintenance of the FotoPortal).
  3. A Data Protection Officer has been appointed, who can be contacted via e-mail: iod@um.poznan.pl or in writing to the address: plac Kolegiacki 17, 61-841 Poznań.

III. Purposes of Personal Data Processing

  1. User data is processed for the following purposes:
    1. conducting photography contests and selecting laureates,
    2. handing over prizes to the laureates of photography contests,
    3. responding to messages from Users,
    4. ensuring proper service for portal users, in particular within the proposed functionalities and in communication with users,
    5. for statistical purposes.

IV. Collection and Processing of Personal Data

  1. During registration, providing the data listed in the registration form is necessary to perform the services.
  2. In order to register on the FotoPortal, the User will be asked to provide the following data:
    1. First name,
    2. Last name,
    3. Email address,
    4. Password.
  3. Other information is collected automatically as a result of using the website (detailed information is described in the paragraph dedicated to Cookies). This information includes, but is not limited to:
    1. the Internet Protocol (IP) address of the device used to access the FotoPortal (this can sometimes be used to obtain information about the country or city where the FotoPortal is being used),
    2. the address of the site visited immediately before visiting the website www.fotoportal.poznan.pl (hereinafter referred to as the “FotoPortal”),
    3. actions taken on the website, including pages visited,
    4. the time, frequency, and duration of visits to the FotoPortal,
    5. type of search engine and operating system,
    6. type of device from which the User accesses the website, e.g., accessing the website from a personal computer or a mobile device and device identifier (ID),
    7. information collected via Cookies and similar technologies.

V. Sharing of Personal Data

  1. The data that the Administrator may disclose are general statistical summaries that do not allow for the identification of individual users. The Administrator may cooperate with other entities to create, expand, and maintain the FotoPortal's IT system.
  2. User data may be disclosed at the request of public authorities or other entities authorized to such access under legal provisions, in particular when it is necessary to ensure the security of the FotoPortal or the rights of other Users.

VI. User Rights

  1. Data subjects have the right to:
    1. access their personal data
    2. request the rectification of data that is incorrect
    3. request the erasure of data when:
      1. the data is no longer necessary for the purposes for which it was collected
      2. after withdrawal of consent to data processing
      3. the data is processed unlawfully
    4. request the restriction of processing when:
      1. these persons question the correctness of the data
      2. the processing is unlawful, and these persons oppose the erasure of the data
      3. the Administrator no longer needs the personal data for processing purposes, but they are needed by the data subjects for establishing, asserting, or defending claims
  2. Consent to the processing of personal data may be withdrawn at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal.
  3. You have the right to lodge a complaint with the supervisory authority dealing with personal data protection in the Member State of your habitual residence, place of work, or place of the alleged infringement.

VII. Data Storage Period

  1. The Administrator stores Users' personal data for the duration of their use of the FotoPortal, as well as after its completion for the purposes of:
    1. asserting claims in connection with the performance of the contract,
    2. fulfilling obligations resulting from legal provisions, including in particular tax and accounting regulations,
    3. preventing abuse and fraud,
    4. statistical and archiving purposes,
    5. the possibility of using photographs for the promotional purposes of the City of Poznań.

VIII. Cookies

  1. The FotoPortal uses cookies to adapt the service to the needs of users, as well as for statistical purposes.
  2. Cookies are small text files sent by the visited website to the internet user's device (computer, smartphone, etc.). They do not contain any personal data.
  3. The FotoPortal uses two types of cookies:
    1. performance (collecting information on how visitors use the site, e.g., most frequently visited pages or error messages, etc.),
    2. functional (saving user settings, e.g., language, expressed consents, etc.),

IX. Changes to the Privacy and Cookies Policy.

  1. The City of Poznań reserves the right to change and update this Privacy and Cookies Policy. Users will be immediately informed of any changes via the FotoPortal.
  2. If the User uses the FotoPortal after changes are introduced, they accept the changed principles. If the changes are significant, a clearer notification may be provided or consent obtained as required by law.
  3. Effective date of this Privacy and Cookies Policy: April 1, 2019.
